A note about insurance privacy law

Insurance agencies are treated as “financial institutions” under the federal Gramm-Leach-Bliley Act, and are additionally subject to state insurance information privacy statutes modeled on the NAIC Insurance Information and Privacy Protection Act. Those laws govern how nonpublic personal information — including financial and health information collected in connection with an insurance transaction — may be collected, used and disclosed. This policy is intended to describe our practices consistent with those obligations as well as with applicable state consumer privacy laws.

Who processes my personal information?

Pinnacle Life Group, a licensed independent insurance agency with its principal office at 209 Philadelphia Ave., Egg Harbor City, NJ 08215, is the controller of the personal information collected through thepinnaclelifegroup.com and pnclgrp.com and is responsible for your personal data (collectively referred to as “thepinnaclelifegroup.com,” “we,” “us” or “our” in this privacy policy).

What does this Privacy Policy cover?

This Privacy Policy covers thepinnaclelifegroup.com treatment of your personally identifiable information (“Personal Information”) that thepinnaclelifegroup.com collects when you are accessing any of thepinnaclelifegroup.com Service and when you use our services.

Information we collect

We believe your Information is no one else’s. Your privacy is important to you and to us. So we’ll ensure at all times that we protect the information you share with us. To protect your privacy, thepinnaclelifegroup.com follows different principles in accordance with world-wide practices for customer privacy and data protection and we won’t sell or give away your name, phone number, and email address, or any other information to anyone. Personal information means all information that relates to an identified individual or to an identifiable individual. For example, your full name, email address, and phone number. Personal information is also referred to as information about you. The information we collect from our users enables us to personalize and improve our services and at the same time, to allow our users to set up a meeting with us. We may collect, store, make use of and transfer different kinds of personal data about you. We may collect personally identifiable information about you which may include but not limited to your provided full name email address, phone number, IP address, browser information, and any other information you provide in connection with the use of our website.

In practice, our consultation form asks for: your first and last name, email address, telephone number and ZIP code; the product you are asking about; and anything you choose to write in the free-text message field. Sharing health information is never required in order to submit the form.

Information gathered automatically

When you visit the Site, our hosting infrastructure automatically records limited technical information in server logs, such as your IP address, browser type, and the page you requested. We use this information to operate the Site, maintain security, and prevent abuse. The Site sets only the strictly necessary cookies described in our Cookie Policy — for example, cookies that keep signed-in agents and administrators signed in, and cookies our payment processor (Stripe) sets during checkout on its own pages. We do not run analytics or advertising cookies, we do not use third-party tracking partners, and no one collects information about your activity over time or across other websites or applications through our Site. We do not share information about your use of the Site, in aggregate form or otherwise, with advertising or analytics partners.

Our forms do not ask for Special Categories of Personal Data (such as details about your ethnicity or race, philosophical or religious beliefs, political opinions, sex life, sexual orientation, trade union membership, or genetic and biometric data), and we do not gather such data automatically. Because we help people evaluate life, health and Medicare coverage, you may choose to share information about your health in a free-text field or other message to us. If you do, we treat it as sensitive personal information: we store it securely, use it only to respond to your inquiry and prepare your consultation, and never sell it or use it for advertising. You can limit its use and disclosure or ask us to delete it as described on our Your Privacy Choices page. We do not collect any information about criminal convictions and offenses.

Information from other sources

If you ask us to obtain quotes, insurance carriers and their underwriting service providers may return information about you to us — for example an underwriting decision, a rate class, or the result of a prescription-history or motor-vehicle-record check that the carrier performs as part of its own process. Carriers disclose those practices in their own applications and notices.

Why and how we use your personal information?

We collect this personal information to communicate with you and respond to your requests. Specifically, we use the information you provide to: respond to insurance inquiries submitted through our forms and connect you with a licensed agent; retain, with each submission, the exact consent language you agreed to (your prior express written consent under telemarketing laws) as a compliance record; and process event registrations and ticket purchases, including sending confirmations and receipts.

We also use this information to determine whether a product can lawfully be offered to you in your state (that is why our forms ask for your ZIP code); to operate and secure the Site and to detect and prevent fraud and abuse; and to comply with insurance, telemarketing and other legal recordkeeping obligations. We do not use your information to make automated decisions that produce legal or similarly significant effects about you. Underwriting decisions are made by insurance carriers under their own processes and notices.

Consent to be contacted

If you check the consent box on one of our forms, we record the exact wording you were shown, the time you submitted it, the page you submitted it from, and the IP address the submission came from. We keep the wording as a snapshot so that a later change to our forms never alters the record of what you actually agreed to. Consent is not a condition of purchase, and you may revoke it at any time — by replying STOP to a text message, by telling the agent directly, or by contacting us at connect@thepinnaclelifegroup.com. Revoking consent to marketing contact does not affect any coverage already in force, and does not prevent us from sending transactional messages about a request you have with us.

How secure is my personal information?

At thepinnaclelifegroup.com we have implemented appropriate measures to protect your personal information against any form of alteration, unauthorized access or disclosure as well as all other forms of unlawful or unauthorized processing (including, but not limited to, unnecessary collection) or further processing. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. Unfortunately, the sending of information via the internet is not totally secure and on occasion such information can be intercepted. We cannot guarantee the security of data that you choose to send us electronically, sending such information is entirely at your own risk.

Consultation requests submitted through our forms are stored in a database that enforces deny-by-default access control: access to those records is restricted to the server side of our application and to authorized staff, and no public, browser-side credential can read or write them. Data is encrypted in transit. Please do not send sensitive information such as a full Social Security number, bank account details or detailed medical records through the website forms. If anything of that kind ever becomes necessary, a licensed agent will tell you the appropriate way to provide it.

Email communications

We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease to third parties, and will not disclose your email address to any third parties except as allowed in the section titled Disclosure of Your Information. We will maintain the information you send via email in accordance with applicable federal law. In compliance with the CAN-SPAM Act, all e-mails sent from our organization will clearly state who the email is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us. Disclosing your information

In summary, we use your information to provide, maintain, and improve the Services. In this section you’ll find detailed descriptions of what we do with your data. Your Personal Information may be stored or processed by our local or foreign subsidiaries or affiliated companies located inside or outside the United States. We use reasonable efforts to engage or interact only with third-party service providers and partners that have a high level of credibility and post a privacy policy setting out how they handle Personal Information.

When you submit a consultation request, your information is shared with the licensed agent handling your request and — where you ask us to seek coverage or quotes — with the insurance carriers we approach on your behalf. We do not sell your personal information, we do not share it for cross-context behavioral advertising, and we do not pass it to lead marketplaces, to unaffiliated marketers, or to your mortgage lender. See our Your Privacy Choices page for the rights available to you.

We rely on a small number of service providers to operate the Site: Stripe processes event-ticket payments (card details are entered directly with Stripe on its own checkout pages; we do not receive or store card numbers); Supabase hosts our database and authentication; Resend delivers our transactional email; and Vercel hosts the Site and its server logs. Each of these providers processes personal information only to provide services to us.

We may also disclose personal information where required by law, subpoena or a regulator; to establish or defend legal claims; to investigate suspected fraud or abuse; or to protect the rights and safety of any person. If we are ever involved in a merger, acquisition or sale of assets, personal information may be transferred as part of that transaction, subject to this Privacy Policy continuing to apply to it.

Payments and event registration

When you buy tickets to one of our events, we collect the purchaser’s and guests’ names, email addresses, and contact details. We use this information to issue your tickets, send receipts and confirmations, and manage check-in at the event. Payment itself is handled by Stripe under its own privacy policy; card details are entered directly with Stripe on its checkout pages and never pass through our servers. If you provide information about other guests, you are responsible for the notices and consents described in the section titled “What are your responsibilities?”

In the event that we include links to third parties on this website. It’s better to be safe and review their privacy policy before sending them any personal data. Our website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy/notice of every website you visit.

Data retention

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. Consent records for insurance inquiries are retained to evidence compliance with telemarketing and insurance regulations, even after other data is deleted.

Access to your provided information

You have the right to request access to, a copy of, correction of, or deletion of the personal information we hold about you, free of charge. We verify your identity before acting on a request and respond within the window applicable state law requires; see our Your Privacy Choices page for how to submit a request.
